In Deut. 4:26, Moses states "I call heaven and earth to witness against you today." He will use this phrase more than once in Deut. Some spiritualize "heaven and earth" to mean the rulers and the common people but it seems here that it is literally the "heaven and earth" even though they are personified. It is easy to understand him as stating that since the heaven and the earth will always be present, they are to witness the obedience or disobedience of Israel; and if disobedience then a Jew should always understand that they are suffering as was prescribed by Moses BECAUSE of their failure to keep the covenant.
Is there a place in Deuteronomy where the context favors using "heaven and earth" as symbolical rather than the literal?

Here are the other two instances this phrase is used in Deuteronomy:
Deu 30:19 I call heaven and earth to record this day against you, that I have set before you life and death, blessing and cursing: therefore choose life, that both thou and thy seed may live:
Deu 31:28 Gather unto me all the elders of your tribes, and your officers, that I may speak these words in their ears, and call heaven and earth to record against them.

I agree with your thoughts above and for the same reasoning suspect these two verses are similar to the one you quoted, but I could also see a potential symbolic meaning with either one too. Were you thinking of a verse in particular?

Yes, the verse in Deut. 32:1- Moses' song. Deut. 32:1 has been quoted as "heaven" being the rulers and "earth" being the common people but there is no indication in the context to suggest that. I understand and agree that "heaven" and "earth" can be symbols for positions of people but there is usually some indication that it is symbolical. I don't think it is here but rather I think it is Moses' way of doing the same thing as in previous chapters- have the everlasting heavens and earth witness what he states.

Interesting. You are right though, we often hear an explanation that sounds good, and without looking fully into it, we accept it as fact. Always good to hear alternatives to see if what we believe is accurate or not.
